Inside the Barnstable County Probate & Family Court
The Barnstable County Probate and Family Court has jurisdiction over mid-Cape family and probate matters such as:
- Divorce
- Child support
- Child custody
- Visitation
- Adoption
- Termination of parental rights
- Abuse prevention
- Wills, estates, trusts, guardianships, conservatorships and changes of name
The court is located at 3195 Main St. in Barnstable and is accessible by the Barnstable Villager line of the Cape Cod Regional Transit Authority. Both the Sturgis Library and the Barnstable Restaurant and Tavern are across the street from the courthouse.
Divorce actions are the most common matters heard in this court, and parties can choose between a Joint Petition for Divorce (1A) where both parties are in complete agreement on every issue, or a Complaint for Divorce (1B) where one spouse files against the other claiming a no-fault divorce based only upon an irretrievable breakdown of the marriage. In Barnstable County, judges are assigned randomly by docket number.
