Massachusetts Local Bankruptcy Rules

How Massachusetts Handles Bankruptcy Proceedings

While bankruptcy is a matter that’s handled at the federal level, states have unique bankruptcy rules. For the United States Bankruptcy Court for the District of Massachusetts, there are a unique set of local bankruptcy rules to review. If you’re filing for bankruptcy, your attorneys should be familiar with these rules and be ready to guide you through the process.

For help with bankruptcy rules in Massachusetts, call our firm today at (508) 502-7002 for a free consultation. We’re ready to listen to your situation and help you decide what steps you should take next.

What the Bankruptcy Rules Dictate

The most recent version of the state’s bankruptcy rules was released in 2016. The document is split into nine parts. Besides containing information for filing bankruptcy and the proceedings involved with it, the rules also provide the official versions of local forms that a person might need to fill out during the process.

The parts of the Massachusetts bankruptcy rules are the following:

  1. Commencement of Case: Proceedings Relating to Petition and Order for Relief
  2. Officers and Administration
  3. Claims and Distribution to Creditors and Equity Interest Holders
  4. The Debtor: Duties and Benefits
  5. Bankruptcy Courts and Clerks
  6. Collection and Liquidation of the Estate
  7. Adversary Proceedings
  8. Appeals
  9. General Provisions

Some of these rules do not apply to all types of bankruptcy. For example, rules for the liquidation of estates won’t apply to Chapter 13 bankruptcy since that process does not involve liquidation.
